In this project, our Experts delivered an Opinion on the document “Assessment of legitimacy of the Employer’s charging the Contractor with contractual penalties in the amount of PLN 31,500,000.00 pertaining to the settlement of contract no. OSP/DI/INW/93/2012 of September 12, 2011, for the implementation of the “Construction of a 400kV Ełk – Łomża line” project task.” In accordance with the agreement of the Parties as in Annex no. 1 of July 19, 2017 to the Agreement of June 2, 2017, its purpose was to resolve the dispute between the Employer and the Contractor regarding the Contractual Penalty charged by the Employer.
In this project, our Experts delivered an Opinion on the evaluation of the Contractor’s and the Employer’s claims in relation to their court dispute on the continuation of the construction of the Stadium in Wrocław, and on the execution of the detailed plans by the Contractor, pertaining to an amicable resolution attempt.
In this project, our Experts delivered an Opinion on the evaluation of circumstances interfering with the implementation of the upgrade task– thermal performance improvement for 5 public buildings in Gdynia, and preparation of a delay analysis for the impact of the said circumstances on the execution of works and on the final date, and thus entitling the Contractor to extend the deadline for the entire task.

In the course of contract execution, the following were successfully achieved: extension of the Contract Time for Completion by a total of 11 calendar months in relation to the Basic Time for Completion as a result of positive consideration of the Contractor’s delay claims – securing the Contractor against the charge of contractual penalties in the amount of PLN 21,200,000.00 for exceeding the TFC, and in the amount of PLN 8,900,000.00 for non-performance of the MinQty, extra payments as a result of positive settlements of the Contractor’s financial claims, and issued Variation Orders in the total amount of ca. PLN 30,000,000.
